European Commission Expert Group on Restructuring and Insolvency Law: Some Personal Observations

Personal observations to the substance and the organisation of the work within the Expert Group on Restructuring and Insolvency Law advising the European Commission. The agenda included the recast of the Insolvency Regulation (Regulation (EU) 2015/848), the discussions leading to the Preventive Restructuring Directive (Directive (EU) 2019/1023) and the recently adopted Directive (EU) 2016/799 harmonising certain aspects of insolvency law. A Commission Decision of 30 May 2016, laying down 'Horizontal rules for the creation and operation of Commission expert groups' gradually determined the working method of the Expert Group. With this contribution, I aim to demystify the position and role of a member of the European Commission's expert panel.
