Emilio Salice, Senior Associate, and Saya Taneja, Associate, Freshfields LLP, London, UKSynopsis
The English High Court (the 'Court') granted an application by the joint administrators of a company (the 'Joint Administrators') to exclude from its statement of affairs information relevant to the value of assets for sale on the basis that its disclosure may negatively impact the price realised for those assets. For the same reason, the Court also agreed that this application should be heard in private. The Court made these orders to protect the confidentiality of certain information and therefore the commercial interests of the administration estate.
